The same logic applies to spam, which is becoming an issue of concern. Every week I have to spend some time deleting comments that have nothing to do with this blog’s subject. The number of automated splogs is also growing. These are phony blogs where I’ve seen quite a few of my articles posted. Many do not credit the source and some even make up the author’s name.

Freedom of speech is the foundation of a functioning democracy. The Copyright Act says that "fair use...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright."
The law favors "transformative" uses — commentary, either praise or criticism, is better than straight copying — courts have said that even putting a piece of an existing work into a new context (such as a thumbnail in an image search engine) counts as "transformative."
